So firstly you will need to carry out a search, we recommend both an unregistered and registered search and you can do this via the UKIPO/Google/Companies House.

Remember that its a good idea to try and do both as often someone using a brand in an unregistered sense can cause you problems.

Once you have decided on a brand then you can consider the type of trade mark.

In your instance you will have the following options:-

Word only, that is ‘Pete’s Putty’ written in the box in the application.

Word Logo, that is ‘Pete’s Putty’ in a word/logo as the above the example.

Logo only, that is no words, for example, the swoosh in the Nike brand.

Next consider the classes you will be seeking to register Pete’s Putty under.
