We advise all our clients to undertake a trade mark search first, then we choose the right filing basis for you: in use, intent to use, or based on a foreign application or registration.

Step 2
Filing
Filing and Examination
Step 1 examine trademark application

We file your application and handle the USPTO examination, addressing any issues raised in the Examination Report so your application can continue towards registration.

Step 3

After publication in the official Gazette, your mark proceeds to registration, or to a Notice of Allowance for intent-to-use filings. We manage Statements of Use, extensions and post-registration declarations.

An excellent company who gave us an all round great experience. Ellis was very patient with us, happy to explain everything really clearly and successfully guided us through to getting our trademark! A big thank you to them.
Carol
Trademarkroom has been guiding us through our trade mark application and has been excellent throughout. Michael explained everything clearly from the start, including the potential challenges, and has always been realistic and transparent in his advice. He has taken the time to speak with the examiner directly and prepared detailed submissions on our behalf. As a business owner dealing with an unfamiliar process, having someone knowledgeable and approachable has made a huge difference. We recommend Trademarkroom!

We have used Trademarkroom for over 10 years and cannot recommend them highly enough. Unfortunately not all applications are as straight forward as we would like but with TMR's professional help and guidance we usually get the right result!

Common Questions About Our US Trade Mark Service

Here are some frequently asked questions about our US and Canadian trade mark service. We have provided detailed answers to help you understand our process better.

Do I need a US attorney to file a US trademark?

Since August 2019, the USPTO requires all foreign-domiciled applicants to be represented by a US-licensed attorney. We handle this for you through our in-house US attorney, so your application is fully compliant from day one.

How long does US trademark registration take?

A straightforward US application typically takes 12 to 18 months from filing to registration, depending on whether the USPTO raises any objections or the application is opposed.

What is the difference between a use-based and an intent-to-use application?

A use-based application is filed when you are already trading in the US. An intent-to-use application lets you reserve the mark before launch, with a Statement of Use filed once you begin trading.

Can you also file my trademark in Canada?

Yes. We handle Canadian applications through the Canadian Intellectual Property Office (CIPO) and can coordinate US and Canadian filings together to keep your North American protection consistent.

How much does a US trademark application cost?

Our fixed legal fee for a US application is £800 plus VAT, and the USPTO official fee is $350 per class. We always confirm the full cost before any filing takes place, so there are no surprises.
