Trademark registration in Cambodia
The D/IPR will issue a notice of acceptance of mark registration when the mark application is deemed to comply with the requirements of the Trademark Law, and a certificate of mark registration will be issued.
In Cambodia, trademark applications are filed with the Ministry of Commerce’s Department of Intellectual Property Rights (D/IPR). Foreign applicants must appoint a Cambodian trademark agent, while local individuals and companies may file directly or through a licensed agent. If an agent is used, a notarised or certified power of attorney (POA) is required, which can be submitted at the time of filing or within two months thereafter.
Cambodia
Cambodia follows the Nice and Vienna Classifications, even though it is not a signatory to those agreements. Class headings are not accepted unless the goods or services are identified. Figurative elements must be described, and non-English words must be transliterated and translated. Multi-class applications must be filed as a single application.
Priority under the Paris Convention must be claimed within six months of the original filing abroad, accompanied by full details and a certified copy of the priority document, which must be submitted within three months of the Registrar’s request.
To file, applicants must provide their name and address, a sample of the mark, the classification, and a list of goods or services and pay the official fee. Once filed, an acknowledgement is issued, and the mark is published online by D/IPR and WIPO.
The process typically takes 9 to 12 months. An expedited examination may be requested, accompanied by a written explanation. Once approved, a notice of acceptance is issued, followed by the issuance of the registration certificate.
Our fees are subject to VAT and may vary depending on your specific needs. The standard fee quoted applies to one mark in one class of goods or services. Additional classes or complex cases may result in increased costs. Please note that not all names or logos are registrable, and all applications involve an element of risk. While we do everything possible to increase your chances of success, applications are non-refundable and cannot be amended once they have been filed.
