Germany, Europe’s largest economy, has a robust trade mark system. Whether you’re local or international, understanding registration through the DPMA (German Patent and Trade Mark Office) is key.

Trade Mark Options in Germany

Two main routes:

  • National German trade mark
  • EU Trade Mark (EUTM) via EUIPO

National marks protect only in Germany. EUTMs cover all EU countries. Choose based on business scope.

Costs:

  • German trade mark: €290-€300 for up to 3 classes; €100 for each additional class
  • EUTM: €850 for 1 class

Filing in Germany

Apply via DPMA online or on paper. Provide:

  • Applicant details
  • Mark (word/logo)
  • List of goods/services (Nice Classification)

Germany registers the mark before the opposition phase. The opposition window is 3 months after registration.

Timeline:

  • Standard: 3-6 months
  • Accelerated: as little as 2-3 months (for €200 extra)

Registrability and Special Rules

Germany follows EU rules:

  • Distinctiveness is essential
  • Descriptive terms, geographic indicators, and common surnames face challenges
  • Public morality and symbols of state are protected

Germany allows non-traditional marks (sounds, colours, shapes), but the burden of proof is high.

Enforcement in Germany

Germany is IP enforcement-friendly:

  • Cease-and-desist letters (Abmahnung)
  • Injunctions and damages in specialized courts
  • Customs enforcement

Trade marks must be used within 5 years to avoid cancellation. Germany also allows administrative cancellations.

International Strategy

Germany is part of the Madrid System, so marks can be extended to/from Germany via WIPO.

Consider EU marks if operating beyond Germany. Many companies hold both EU and national marks.
