The Nice classification is a trade mark classification system used by Intellectual Property Offices worldwide that divides similar goods and services into 45 classes. Each class has a list of terms that cover all the goods and services included in that class: goods are in classes 1 through 34; services are in classes 35 through 45; each class has a broad heading that describes what is covered in that specific class; this is only a general indication and does not include all the goods and services in that class.
Selecting the Correct Classes for Your Application:
It is Crucial that you select the correct classes and terms for your Trade Mark; once you apply, you cannot add more goods or services. For instance, if you want to use your Trade Mark for your own clothing line, you would select class 25 (clothing, footwear, and headgear); if you want to use it in a store that sells other people’s products, you would select class 35 (Advertising; business management; business administration; office functions) and choose the term ‘Retail services in relation to clothing’.
