Step-by-Step Guide to Filing a Trade Mark in the UK

1. Understand Trade Mark Classes 4-6

  • Class 4: Lubricants, fuels, illuminants, candles, and wicks for lighting; dust-absorbing, wetting, and binding compositions; industrial oils and greases.
  • Class 5: Prescription drugs, veterinary and medical supplies, hygienic supplies for medical use, dietetic food and materials modified for medical or veterinary use, infant food, nutritional supplements, plasters, dressing materials, dental wax, stopper materials, disinfectants, vermin-destroying solutions, fungicides, and herbicides.
  • Class 6 includes common metals and their alloys, metal building supplies, transportable buildings made of metal, materials for railway tracks made of metal, non-electric cables and wires made of common metal, ironmongery, small metal hardware items, metal pipes and tubes, safes, common metal goods not covered by other classes and ores.

2. Conduct a Trade Mark Search

  • Before filing, it’s important to search the UK Intellectual Property Office (UK IPO) database to ensure that your trademark is unique and not already in use.

3. Prepare Your Application

  • Details Required:
    • Owner’s name and address
    • Representation of the trademark (word, logo, etc.)
    • List of goods/services the trademark will cover, specified by class (4, 5, and/or 6)
    • Statement of use or intent to use the trademark in the UK

5. Pay the Fees

  • The standard fee for online applications is £170 for one class, plus £50 for each additional class. Therefore, for classes 4, 5, and 6, the fee would be £270.

6. Application Review Process

7. Responding to Opposition (if applicable)

  • If your application is opposed, you will need to respond within the specified timeframe. You may negotiate a settlement or defend your application through a hearing.

8. Registration

  • If no opposition is filed, or if opposition is resolved in your favour, the UK IPO will issue a Certificate of Registration. Your trademark will then be registered for 10 years, after which it can be renewed.

9. Post-Registration

  • Monitoring: Regularly monitor the market to enforce your trademark rights.
  • Renewal: Renew your trademark every 10 years to maintain protection.
